Syarat & Ketentuan

In Using The LinkQuservice, Users ("Number") agrees and binds himself to comply with the LinkQu Terms of Use (“Terms”) as follows:

Terms organize and apply for access to and use LinkQu applications and www.linkqu.id and other services operated by PT Tri Usaha Berkat and / or affiliated (“LinkQu”, “Kita”, atau “Kami”) which is connected to the terms and provided conditions (“Site”) and mobile applications LinkQu with the terms and conditions provided ( “Applications”). Sites and Applications are collectively referred to as “Services.”

WITH CLICKING “REGISTER” ON THE SITE OR by downloading, installing OR ACCESSING OR USING THE APPLICATION OR SERVICE, YOU DECLARE THAT YOU have read, understood, AND AGREE TO BE BOUND BY THE FOLLOWING TERMS, INCLUDING THE PRIVACY POLICY.

You previously acknowledge and agree that:

  • The Application is licensed, not sold to you, and you can only use the Service as stated in the Terms;
  • When you first create an account on the Service, we may ask for your phone number to verify your account with a text message (SMS) and text are paid from your mobile network operator (operator) shall apply.
  • Use of the Service may be subject to terms and conditions of any third party that is separate from the service and charges, including without limitation the terms and conditions of service and data, SMS, MMS, and other costs of the operator, which is your responsibility; and

  1. USE OF SERVICES

    Based on the Terms (including but not limited to compliance with the Terms), you have a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and install a copy of the application service provider legitimate (such as Apple App Store or Google Play Store) for your device, and to access and use the service, which in any case, only for your personal use.

    You may not: (i) copy, modify, or create derivative works of the Service (or any part thereof) for any purpose; (Ii) distribute, publicly display, perform in general, transfer, sell, sublicense, lend, rent or provide the Service (or any part thereof) to a third party; (iii) decompile, reverse-engineer, disassemble or otherwise intervene in or circumvent the Service (or any part thereof), including without limitation security or access control mechanisms; or (iv) use the Service (or any part thereof) in any unlawful manner, for any unlawful purpose, or act outside the purpose set forth in the Terms.

    Our services are subject to change - time and / or we may stop (permanently or temporarily) providing the Services (or any features within the Services), without prior notice to you. Our services may include advertisements, which may be targeted to the content or information on the Services, queries made through the Services, or other information. The type and extent of advertising on the service is also subject to change over time. In consideration for providing you the Services, you agree that we and our third party providers and partners may place such advertising, our services or with respect to the display content or information on our services.

    Features - certain features of our services may be subject to additional terms and conditions, which will be attached to the feature. Additional terms and conditions will be used as a reference in the Terms of Use of Service.

    In order to download the Application, you may be asked by third parties who provide services in connection with the Application, including but not limited to, Apple, Inc. or Google (each, a “Service Provider”) to create an account. You are responsible for maintaining the security of any login, password, or other credentials that you choose or are given to you to access your account with the Service Provider. Your access to and use of any account with the Service Provider, including without limitation in connection with the Service, is subject to the Service Provider's terms, conditions and policies, including the Service Provider's Privacy Policy. LinkQu is not responsible for any acts or omissions of any Service Provider. LinkQu does not provide you with equipment to access or use the Service. You are responsible for all fees charged by third parties to access and use the Service (for example, carrier fees). Without limiting the foregoing, you are fully responsible for the payment of all costs associated with the operator in connection with the use of the Service (such as voice mail, data packages, SMS, MMS, roaming and other fees charged by the operator). Therefore, you must be careful in choosing the type of service provided by your operator. If your device is lost or stolen, you must notify LinkQu immediately to prevent crime.

  2. ACCOUNT CREATION

    In order to access and use the Service, you must register and create your account (“Account”). By creating an account, you represent that you are of legal age to form a binding contract, not a person barred from receiving services under the laws of the Republic of Indonesia or other applicable jurisdiction, and have never been previously suspended or removed as users of the Service. 

    When creating your account, you may be asked to provide an email address and phone number to verify your account via text message. Keep in mind that the operator may charge you a text message. When creating your account, you may also be asked to provide certain personal information about yourself including creating and filling a (username) and password. We reserve the right to delete or reject (username) We reserve the right to remove or refuse a username if we determined to be appropriate, for example, if the (username) indicates that you are someone else, not yourself.

    You agree to provide and update accurate, current and complete information about your Account, including your mobile number. Without limiting the foregoing, in the event you change or deactivate your mobile number, you must immediately update your account information to ensure that your message is not sent to people who obtain your old number.

    When creating an Account, you are not allowed to:

    • provide false personal information to us (including (username) is false) or create an account for anyone other than yourself without permission of the person;
    • using a (username) which is the name of another person with the intent to impersonate that person;
    • using a (username) which is subject to the rights of others without proper authorization; or
    • using or linking financial instruments belonging to or on behalf of any party other than yourself into LinkQu.Kami application reserves the right to suspend or terminate your account if the information provided during the registration process or later proven to be inaccurate, false or misleading, or we may remove (username) that you created through the Service if it is found there is a violation of the Terms of use of Service. You are responsible for maintaining the confidentiality of your password and account, and agree to notify us if your password is lost, stolen, or disclosed to unauthorized third parties, or may have fallen into the wrong hands. You are responsible for activity that occurred in your account. If you have reason to believe that your Account is no longer secure, then you must immediately notify us at [email protected].
  3. PAYMENT
    Access to the Service, or certain features of the Service, may require you to pay a fee to LinkQu and which may apply to other Service Providers. If you have questions or problems with the payment, please contact LinkQu or Related Service Provider, as relevant.
  4. COPYRIGHT POLICY

    We do not allow activities of copyright infringement and violations of intellectual property rights in the Service and will remove all Content if properly notified that the content in question has violated intellectual property rights of others. If you are the copyright owner or an agent thereof and believe that your content has been infringed, you can send notification by providing LinkQu with the following information in writing:

    • Descriptions of copyright (eg, either the content or URL), which you claim has been infringed, along with an electronic signature or wet of the person authorized to act on behalf of the copyright owner;
    • Address information, phone numbers, and email address;
    • Stating that the above information is accurate and is given in good faith, and acknowledge that you are the copyright owner or acting for and on behalf of the actual copyright owner.

  5. UNAUTHORIZED ACTIVITIES
    Our Services may only be used and accessed for lawful purposes. You agree that you will not do any of the following when using or accessing the Services: (i) attempt to access or seek services or download content from the Services through the use of machines, software, tools, agents, devices or mechanisms (including without limitation, robots, crawlers, data mining tools or the like) other than software and/or agents provided by us or other commonly available third party web browsers; (ii) access, tamper with, interfere with or use non-public areas of the Service, our computer systems, or the technical delivery systems of our providers, including without limitation by uploading or distributing viruses, adware, spyware, worms or other malicious code ; (iii) collect and use information, such as other user names, real names, email addresses that exist on the Service and are used to send unauthorized advertisements, junk mail, spam or other forms that are not desirable; (iv) use the Services for commercial purposes or for the benefit of third parties or in a manner not permitted by the Terms; (v) violate any applicable law or regulation; or (vi) encourage or enable other individuals to do any of the above; or (vii) interfere with other users' enjoyment of the Service, including without limitation by (a) making unsolicited offers or advertisements to other users of the Service or (b) attempting to collect personal information about other users or third parties without their consent. We reserve the right to investigate and prosecute violations of any of the above and/or involve and cooperate with law enforcement authorities in prosecuting users who violate the Terms.

  6. COMPENSATION
    You agree to indemnify and hold LinkQu and its officers, directors, employees, consultants, advisors, affiliates, subsidiaries and agents free from any and all claims, costs, damages, liabilities and expenses (including without limitation attorneys' fees) incurred to us in connection with or arising out of (i) your access to or use of the Service, (ii) your violation of the Terms or any applicable law or regulation, (iii) your violation of the rights of third parties, including without limitation intellectual property rights or rights of publicity, confidentiality, property or privacy; or (iv) any dispute or issue between you and a third party. We reserve the right, at our own expense, to exercise the exclusive defense and control of any material relating to your indemnification (and without limiting your indemnification liability in respect thereof), and in this regard, you agree to cooperate with our defense of the claim.
  7. LINKS TO THIRD PARTY SITES
    This service also includes links to other sites and services that are not operated by us. We are providing these links to you only as a convenience and are not responsible for the content or links that appear on these sites. You are responsible for and bear all risks arising from the use of or reliance on third-party sites. LinkQu may provide tools through the Service that allows you to export information, including without limitation the content, for third party services. By using this tool, you agree that we may transfer such information to third-party services that apply. Such third party services are not under our control, and we are not responsible for the use of your exported information.
  8. CHANGES TO TERMS
    We reserve the right to change the applicable Terms in the future. Please check the Terms periodically to see if there are any changes. In the event that a change to the Terms affects your rights and obligations, we will endeavor to provide you with a notification regarding the change. We may provide notifications via pop-up message or banners within the Service, by sending an email to the address you used to register an Account, or through other similar mechanisms. In addition, if a change to the Terms changes your rights and obligations, we may ask you to give your consent again to accept the changed Terms. If we require your consent to a change to the Terms, the effect of the change will only take effect after you accept the modified Terms. If you do not accept the changes to the Terms, you can inform us to be able to terminate your access to the use of the Service. All other changes will take effect upon publication of the changed Terms. Disputes arising in connection with the Terms will be resolved in accordance with the provisions of the Terms in effect at the time the dispute arose.
  9. OWNERSHIP
    Our services (including without limitation the Application) are protected by copyright, trademark and other laws of the Republic of Indonesia. Except as expressly provided in these Terms, we (or our licensors) exclusively own all right, title and interest in and to the Service (including without limitation the application), including all related intellectual property rights. Except as expressly provided in these Terms, you may not use the Service, and LinkQu owns all rights to the Service. You may not remove, modify or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Service (including without limitation the Application). You acknowledge and agree that any feedback, comments or suggestions you have regarding the Service (including without limitation the Application) ("Feedback"). Would be the sole and exclusive property of LinkQu and you hereby grant the rights to any such Feedback.
  10. TERMINATION

    If you violate any of the provisions of the Terms or We find suspicious activity that violates the law, then We, with or without prior notice, may temporarily suspend Your access to use the Service or permanently terminate Your Account, after conducting an investigation supported by sufficient evidence to LinkQu to assess that there has been a violation or suspicious activity on your Account. We may also take other further actions (including legal action) that are possible according to the applicable laws and regulations, including but not limited to, notification to relevant third parties, such as your bank account manager, in connection with violations we find to get follow-up from the third party. For this purpose, you hereby grant LinkQu an irrevocable power to provide your personal data (which you have provided during the creation of an Account and/or when using the Service) to any third party that has cooperated with LinkQu in relation to the Service.

    You can also submit a request to suspend or permanently delete your account by contacting us via email to [email protected]. Please note that we will continue to keep certain information (including without limitation your transactions) for the purpose of analysis, but that information will not include personal information such as your name, email address, or phone number. We will also keep any information (including without limitation your transaction) as required by law.

  11. DISCLAIMER

    YOU UNDERSTAND AND AGREE THE SERVICES WHICH (INCLUDING AND NOT LIMITED TO THE CONTENT OR MATERIALS OFFERED THROUGH THE SERVICES) IS PROVIDED TO YOU ON AN "AS IS" BASIS AND ON "AS AVAILABLE" BASIS. WITHOUT LIMITATION OF THESE, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR OTHERWISE, INCLUDING AND NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND WARRANTIES OF ANY PURPOSE. WE MAKE NO WARRANTIES THAT THE SERVICES (INCLUDING AND NOT LIMITED TO THE CONTENT OR MATERIALS OFFERED THROUGH THE SERVICES) WILL MEET YOUR REQUIREMENTS OR AVAILABLE ON ERROR-FREE OR HAZARDOUS COMPONENTS. YOU ARE RESPONSIBLE FOR ALL DAMAGES THAT MAY OCCUR AS A RESULT OF YOUR USE OF OR ACCESS TO THE SERVICES (INCLUDING AND NOT LIMITED TO CONTENT OR MATERIALS OFFERED THROUGH THE SERVICES) AND YOUR TRANSACTIONS WITH OTHER USERS OF THE SERVICES.

  12. LIMITATION OF LIABILITY

    OUR TOTAL LIABILITY TO YOU FROM ALL ACTIONS AND IS UNDER ALL THEORY OF LIABILITY WILL BE LIMITED TO THE ACTUAL VALUE OF THE DAMAGES DIRECTLY CAUSED BY US. WE WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO THE USE OR INABILITY TO ACCESS OR USE THE SERVICE (INCLUDING WITHOUT LIMITATION IN IT CONTENT OBTAINED FROM THE SERVICES); (ii) ANY ACTION OR CONTENT FROM ANY THIRD PARTY SERVICES; OR (iii) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING WITHOUT LIMITATION NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

    ANY PROVISION OF THIS ARTICLE ARE SUBJECT TO CHANGE AT ANY TIME AND APART FROM OTHER CONDITIONS TERMS. 

  13. EXCEPTION

    Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

  14. GENERAL
    The terms are governed by the laws of the Republic of Indonesia, without considering any conflict of law rules or principles. We operate the Services from our offices in Indonesia and, as applicable, other countries, and we make no representation that the Services are appropriate or available for use in other locations. You may not assign or assign your obligations or rights under these Terms, in whole or in part, by law or otherwise, without our prior written consent. Our failure to enforce any right or provision of the Terms will not be considered a waiver of those rights. If any provision of these Terms is deemed invalid or unenforceable by law, the remaining provisions of these Terms will remain in effect. These terms are the basis of the entire agreement between you and us in relation to the service and cancel and replace the previous agreements between you and us relating to the service.
  15. DISPUTE RESOLUTION AND ARBITRATION

    In the interest of resolving disputes between you and LinkQu in the most expedient and cost effective manner, you and LinkQu agree that any and all disputes arising in connection with the Terms shall be resolved by binding arbitration. Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited use of findings of the court, and the extremely limited reviewable by the courts. In most cases, the arbitrator may give the payment of damages equal to the courts. Our agreement to the dispute arbitration, including, but not limited to all claims arising out of or related to aspects of the provisions of the Terms, whether based on contract, tort, statute, fraud, misrepresentation or any other legal theory, and regardless of whether the claim arises during or after the end of these Terms.

    Each arbitration between you and LinkQu will be governed by the Indonesian National Board of Arbitration ( "BANI") are recognized as valid by the judiciary in Indonesia with reference to the regulations in force in BANI.

    Parties who intends to seek arbitration must first send a written notice of the dispute to another, by registered mail or via the email address LinkQu relevant. Notification shall (i) describe the nature and basis of the claim or dispute; and (ii) set forth the specific relief sought ( "Demand"). We agree to use good faith efforts to resolve the claim directly, but if an agreement is not reached within 30 days after the Notice is received, you or LinkQu may initiate an arbitration proceeding.

    Each arbitral tribunal will take place in Jakarta, and decisions by the arbitration, including decisions on damages, arbitration fees, and all parties' legal fees and other costs, are final and binding.

    YOU AND LinkQu AGREE THAT ANY PARTIES MAY BRING CLAIMS AGAINST OTHERS ONLY ON OR ON INDIVIDUAL CAPACITY ONLY AND NOT AS A Plaintiff OR CLASS ACTION OR REPRESENTATIVE PROCESS. Further, unless you and LinkQu agree, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of representative or class proceedings.

    If the class action waiver in the two paragraphs above is found to be unenforceable or if the entirety of the Dispute Resolution and Arbitration is found to be unenforceable, the entire Dispute Resolution and Arbitration may be rescinded and, in such case, the parties agree that the exclusive jurisdiction of the courts of the Republic of Indonesia will govern any action arising out of or related to the Terms.

  16. APPROVING ELECTRONIC COMMUNICATION
    By using Our Services, you agree to receive electronic communications from us as further specified in the description of our Privacy Policy. Please read our Privacy Policy to learn more about your options regarding electronic communication practices. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including without limitation that such communications be in writing.
